List2View TERMS AND CONDITIONS


1. ACCEPTANCE OF TERMS

List2View provides a collection of online services, including classified ads, forums, web publishing, web design and email services, subject to the following Terms and Conditions ("TAC"). By using the Service in any way, you are agreeing to comply with the TAC. In addition, when using specific List2View services, you agree to abide by any applicable posted guidelines for all List2View services, which may change from time to time. Should you object to any term or condition of the TAC, any guidelines, or any subsequent modifications thereto or become dissatisfied with List2View in any way, your only recourse is to immediately discontinue use of List2View. List2View may strictly enforce the TAC through mediation, active investigation, litigation and prosecution.


2. MODIFICATIONS TO THIS AGREEMENT

We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms and Conditions at any time. Such modifications shall become effective immediately upon the posting. You must review this agreement on a regular basis to keep yourself apprised of any changes. You can find the most recent version of the TAC at:

3. CONTENT

You understand that List2View does not control, nor is responsible for Content made available through its system, and that by using List2View you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or objectionable. You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated. Also, the List2View site and Content available through List2View may contain links to other websites, which are completely independent of List2View. List2View makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Linking to any other websites is at your own risk. You agree that under no circumstances will List2View be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service.

4. ACCESS TO List2View

List2View grants you a limited, revocable, nonexclusive license to access its service for your own personal use. This license does not include any collection, copying, duplication, display of the service nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by List2View. A limited exception is provided to general purpose internet search engines and non-commercial public archives that use such tools to gather information for the sole purpose of displaying hyperlinks to List2View, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file.

"General purpose internet search engine" does not include a website or search engine or other service that specializes in classified listings or in any subset of classifieds listings such as jobs, housing, for sale, services, or personals, or which is in the business of providing classified ad listing services.

List2View permits you to display on your website, or create a hyperlink on your website to, individual postings on the Service so long as such use is for noncommercial and/or news reporting purposes only (for example; for use in personal web blogs or personal online media). If the total number of such postings displayed or linked to on your website exceeds fifty (50)postings, your use will be presumed to be in violation of the TAC, absent express written consent granted by List2View. You may also create a hyperlink to the home page of List2View sites so long as the link does not portray List2View, its employees, or its affiliates in a false, misleading, derogatory, or otherwise offensive matter.

Use of the Service beyond the scope of authorized access granted to you by List2View immediately terminates said permission or license. In order to collect, aggregate, copy, duplicate, display or make derivative use of the the Service or any Content made available via the Service for other purposes (including commercial purposes) not stated herein, you must first obtain a license from List2View.

5. THIRD PARTY CONTENT, SITES, AND SERVICES

The List2View site and Content available through List2View may contain features that may link you with or give you access to third party content which is completely independent of List2View. Your interactions with organizations and/or individuals found on or through List2View, are solely between you and such organizations and/or individuals. Payment and delivery of goods or services and any other terms, conditions, warranties or representations associated with such transactions are solely between you and the individual or organization.

Should there be a dispute between participants on this site, or between users and any third party, you understand and agree that List2View is not obligated to become involved. You agree that no loss or damage of any sort incurred with such dealings shall be the responsibility of List2View.

6. PRIVACY AND INFORMATION DISCLOSURE

List2View has established a Privacy Policy to inform users how their information is collected and used. The information is located at the following web address:

When you use the List2View website, you signify acknowledgement of, and agree to our Privacy Policy. You also acknowledge and agree that List2View may, at its sole discretion, preserve or disclose your Content, as well as your information, such as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: 1. comply with legal process;
2. respond to claims that any Content violates the rights of third-parties;
3. enforce the TAC;
4. protect the rights, property, or personal safety of List2View, its users or the general public;
5. respond to claims that contact information (e.g. phone number, street address) of a third-party has been posted or transmitted without their consent or as a form of harassment

7. NO SPAM POLICY

You understand and agree that sending unsolicited email advertisements to List2View email addresses or through List2View’s computer systems is expressly prohibited by these Terms. Any unauthorized use of List2View’s computer systems is a violation of these Terms and certain federal and state laws.

8. CONDUCT

You agree not to email, post or otherwise make available Content: 1. that is defamatory, abusive, harmful, libelous, harassing, threatening, unlawful, invasive of one’s privacy or is harmful to minors in any way.
2. that is pornographic or depicts a human being engaged in actual sexual conduct including but not limited to (i) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex, or (ii) bestiality, or (iii) masturbation, or (iv) sadistic or masochistic abuse, or (v) lascivious exhibition of the genitals or pubic area of any person;
3. that harasses, intimidates, degrades or is hateful toward an person or group of people on the basis of religion, sexual orientation, gender, ethnicity, race, age, or disability; or content that violates the Fair Housing Act by stating a discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap (or violates any state or local law prohibiting discrimination on the basis of these or other characteristics); or content that violates federal, state, or local equal employment opportunity laws.
4. with respect to employers that employ four or more employees, that violates the anti-discrimination provision of the Immigration and Nationality Act, including requiring U.S. citizenship or lawful permanent residency (green card status) as a condition for employment, unless required in order to comply with law, regulation, executive order, or federal, state, or local government contract.
5. that impersonates any person or entity, including, but not limited to, a List2View employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.);
6. that includes personal or identifying information about another person without that person's explicit consent; or content that is false, deceptive, misleading, deceitful, or constitutes "bait and switch";
7. that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
8. that contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement; or content that contains any form of advertising or solicitation if: posted in areas of the List2View sites which are not designated for such purposes; or emailed to List2View users who have not indicated in writing that it is ok to contact them about other services, products or commercial interests; or content that includes links to commercial services or web sites, except as allowed in "services";
9. that advertises any illegal service or the sale of any items restricted by Arizona law.
10. that contains computer code, software viruses or any other files or programs designed to interrupt, destroy or limit the functionality of any computer hardware or software or telecommunications equipment;
11. that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or negatively affecting other users' ability to use the Service.

Additionally, you agree not to:

1. attempt to gain unauthorized access to List2View's computer systems or engage in any activity that disrupts or diminishes the quality of the List2View website;
2. collect personal data about other users for commercial or unlawful purposes; or to use automated means to download data from List2View - unless expressly permitted by List2View;
3. post irrelevant Content, repeatedly post the same or similar Content or impose an unreasonable or disproportionately large load on our infrastructure;
4. contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose; or to "stalk" or harass anyone;
5. use any form of automated device or computer program that enables the submission of postings on List2View without each posting being manually entered by the author.

9. TERMINATION OF SERVICE

You agree that List2View, in its sole discretion, has the right to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to List2View, immediately and without notice, and remove and discard any Content within List2View for any reason. Also, you agree that List2View shall not be liable to you or any third-party for any termination of your access to List2View. In addition, you agree not to attempt to use the List2View after said termination.

10. PROPRIETARY RIGHTS

List2View is protected to the maximum extent permitted by copyright laws and international treaties. Any reproduction, modification, or redistribution of any portion of the site is prohibited without written consent of List2View.

Although List2View does not claim ownership of content that its users post, by posting Content to any public area of List2View, you automatically authorize List2View to use, copy, display, and distribute said Content.

11. DISCLAIMER OF WARRANTIES

YOU AGREE THAT USE OF THE List2View SITE IS ENTIRELY AT YOUR OWN RISK. THE List2View SITE IS PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND.

12. LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL List2View BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY ASPECT OF YOUR USE OF THE List2View SITE. LIMITATION EXTENDS TO DAMAGES RELATED TO OTHER SERVICES OR PRODUCTS RECEIVED THROUGH, OR ADVERTISED IN CONNECTION WITH THE List2View SITE OR ANY LINKS ON List2View. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

13. INDEMNITY

You agree to indemnify and hold List2View, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through List2View.
